Backup City is a cloud recording service. You're responsible for what you stream. No illegal content, no porn, no unauthorized copyrighted material, no content involving anyone under 18. We can terminate any account that violates these rules without notice or refund. We don't sell your data. We do our best to keep the service reliable, but we don't guarantee uptime or against data loss — keep your own backups of anything important. 1. Acceptance of Terms

By creating an account, signing in, or otherwise using Backup City (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). The Service is operated by TVTXllc, a Texas limited liability company ("we", "us", "TVTXllc"). If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old and have the legal authority to enter into binding agreements to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Backup City is a cloud-based video recording, storage, and live-streaming relay service designed for live broadcast professionals, drone operators, and video producers. The Service ingests SRT or RTMP streams, records them to cloud storage, and provides web-based playback, sharing, and download capabilities.

We reserve the right to add, modify, or discontinue features at any time, with reasonable notice for material changes that affect existing customers' workflows.

3. Account Registration

To use the Service, you must register an account using a Google or Microsoft sign-in. You are responsible for maintaining the confidentiality of your account credentials, your stream keys, and any device or network you authorize to access the Service. You are responsible for all activity that occurs under your account.

Notify us immediately at abuse@backupcity.app if you suspect any unauthorized access to your account.

4. Acceptable Use

You agree not to use the Service to record, stream, store, share, or distribute any of the following:

Content that violates any local, state, federal, or international law;
Sexually explicit material, pornography, or any sexual content of any kind;
Any content depicting minors in any sexually explicit, suggestive, or exploitative context (this includes simulated, drawn, animated, and AI-generated material);
Material that infringes any copyright, trademark, trade secret, or other intellectual-property right;
Content that constitutes harassment, hate speech, threats, or incitement of violence;
Malware, viruses, or any code intended to damage, interfere with, or gain unauthorized access to any system;
Content related to or facilitating fraud, identity theft, or financial scams;
Any attempt to access another user's content, account, or stream without authorization;
Reverse engineering, scraping, or systematic access of the Service for the purpose of building a competing product.

We reserve the right, but not the obligation, to monitor stored content and live streams for violations. We may, in our sole discretion and without notice, remove content, suspend access, or terminate accounts that we reasonably believe violate these terms.

5. 18 U.S.C. §2257 Notice

The Service is not intended for, and expressly prohibits, the recording, storage, or distribution of any visual depiction of actual or simulated sexually explicit conduct as defined by 18 U.S.C. §2257 and applicable regulations. TVTXllc is not a producer (primary or secondary) of any sexually explicit material; the Service's prohibition on such material in Section 4 above means no §2257 record-keeping obligations attach to TVTXllc. Any user found to have uploaded or streamed material covered by §2257 will have their content removed immediately, their account terminated without refund, and may be reported to law enforcement.

6. Your Content

You retain ownership of all content you upload, record, or stream through the Service ("Your Content"). By using the Service, you grant TVTXllc a limited, non-exclusive, royalty-free license to host, store, transmit, encode, and serve Your Content for the sole purpose of providing the Service to you and the people you share with.

You represent and warrant that:

You own or have all necessary rights, licenses, releases, and consents to upload and stream Your Content;
Your Content does not violate any third-party rights or these Terms;
You have obtained the consent of any individual whose voice or likeness appears in Your Content to the extent required by law.

7. Privacy and Data

We store the following data about you and your usage: account profile information from Google or Microsoft (name, email, profile photo); stream and recording metadata (timestamps, durations, formats, sizes, source IPs); audit logs of authentication attempts and stream connections; recordings and uploads you create. We do not sell, rent, or trade your personal data or content.

We use a small number of sub-processors to operate the Service: Google and Microsoft (authentication), Stripe (payment processing where applicable), Caddy and our hosting infrastructure (network and storage), Google SMTP (transactional email). These providers are bound by their own privacy obligations.

Account and content data is retained while your account is active. After account deletion, data is purged from active systems within thirty (30) days. Audit logs may be retained longer for security and compliance purposes.

8. Service Availability

We work hard to keep the Service available, but we do not guarantee any specific level of uptime, performance, or data integrity. The Service is provided "as is" and "as available". We may perform scheduled or emergency maintenance that temporarily interrupts the Service.

You are responsible for your own backups. We strongly recommend keeping local copies of any recordings that are critical to you. While we use reasonable measures to protect against data loss, we cannot guarantee against hardware failure, network outages, software bugs, or other events that could result in lost or corrupted data.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall TVTXllc, its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits, lost data, or loss of business opportunity, arising from or in connection with your use of the Service.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the total amount you have paid to TVTXllc in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless TVTXllc and its officers, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party right.

11. Termination

You may terminate your account at any time by deleting it from your Account page or by emailing abuse@backupcity.app.

We may suspend or terminate your account immediately and without prior notice if we reasonably believe you have violated these Terms, including the Acceptable Use Policy in Section 4. We may terminate accounts without cause with thirty (30) days' written notice.

Upon termination for cause, no refund will be issued. Your Content will be deleted within thirty (30) days of termination unless legally required to be preserved.

12. DMCA / Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice to abuse@backupcity.app including the information required by 17 U.S.C. §512(c)(3): identification of the copyrighted work, identification of the infringing material with its location on the Service, your contact information, a statement of good-faith belief, a statement under penalty of perjury that you are authorized, and your physical or electronic signature.

We will respond to valid notices in accordance with the Digital Millennium Copyright Act. Account holders who repeatedly upload infringing material will have their accounts terminated.

13. Abuse Reports

To report any other violation of these Terms (harassment, illegal content, account compromise, etc.), email abuse@backupcity.app. We aim to respond to abuse reports within twenty-four (24) hours.

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide reasonable advance notice (typically 30 days) by email and by displaying a notice in the Service. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law provisions. Any dispute arising from or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
